Who is an NRI?
For tax purposes, you are an NRI if you were in India for less than 182 days in the financial year, AND less than 60 days in the current year with 365 days in the preceding 4 years.
Taxable Income for NRIs
- Taxable: Income earned or received in India
- Not Taxable: Income earned outside India
- NRE account interest is tax-free
- NRO account interest is taxable at 30%
TDS Rates for NRIs
- NRO Interest: 30% TDS
- Rental Income: 30% TDS
- Dividends: 20% TDS
- Property Sale: 20% LTCG / 30% STCG
Capital Gains Tax
- Equity STCG: 15% (held less than 1 year)
- Equity LTCG: 10% above ₹1 lakh (held more than 1 year)
- Property LTCG: 20% with indexation
- Debt Fund LTCG: Slab rates (post-April 2023)
